This web site is owned and operated by Spiral Funds, Inc. (hereinafter called SpiralFunds) SpiralFunds takes user privacy seriously and makes every reasonable effort to protect your privacy. We have created this Privacy Policy in order to share with you our information collection and use practices. Please read this policy carefully before sharing any personally identifiable information (hereinafter called PII) described below. This policy applies solely to the web site and service located at www.SpiralFunds.com (hereinafter called Service).

2. Indemnification. You agree to defend, indemnify and hold harmless SpiralFunds for and against any and all claims, actions, demands, liabilities, losses, damages, penalties, interest, judgments, settlements, costs and expenses (including reasonable attorneys’ fees) that directly or indirectly arise out of or are based on your use of the Services.
3. Changes in Privacy Policy. This Privacy Policy may change from time to time. SpiralFunds will post those changes on this page.
B. Collection of Information
1. Collection of Personally Identifiable Information. SpiralFunds requires relevant contact and other information in order to facilitate its Service offerings. This generally includes your name and contact information such as e-mail and postal mail addresses. We will not collect PII from you while you use the Service unless you voluntarily provide it to us or authorize us to collect such information.
You authorize SpiralFunds to receive any account information from any affiliated merchant including, but not limited to, information regarding any purchase made by you through utilization of the Service, such as: the products ordered, the order number, the time and date of the purchase, and the email address entered for the purchase.
2. Collection on Non-Personally Identifiable Information. SpiralFunds does collect and track certain non-personally identifiable information, including but not limited to, user IP numbers and browser type, access times, domain names, usage habits and other information which does not specifically identify any individual. SpiralFunds does NOT receive your credit card number or other personal information that you submit at our featured retailers’ websites. We receive only information regarding transactions so that we may credit purchases to your SpiralFunds account. In some cases, retailers provide us with the actual product or service purchased. We do NOT use or share this additional information.
3. Aggregation. Aggregate Information is information presented in summary or statistical form which does not contain data that would permit the identification of a specific individual without extraordinary effort. SpiralFunds may aggregate information and add it to its database every time a person visits its website.
4. Featured Retailers’ Privacy Policies. When you shop through SpiralFunds, you are redirected to the websites of our featured retailers, where privacy policies may differ from those of SpiralFunds. We are not responsible for the privacy policies of our featured retailers, and we encourage you to understand the privacy policies of any websites to which you submit your personal information.
C. Use of Personal Information
1. Our Information Sharing Policy. SpiralFunds does not now, nor will it ever, sell or rent any PII that you share with SpiralFunds. SpiralFunds also does not otherwise share PII (such as your e-mail address, other contact information, or information regarding your purchases), except as necessary to facilitate payment processing or other service fulfillment operations through third-party partners. In this event, only the minimum information required will be communicated to such third-party providers.
2. Exceptions. The only exceptions to our policy of not sharing member information are: (a) if SpiralFunds is required to do so by law. (b) if ownership of SpiralFunds is transferred, at which point it will be necessary to transfer all information to the new owner(s).
3. How We Use Your Information. As your partners in philanthropy, we include your email addresses with the payments to the causes you designate. If you prefer the cause to treat your payment anonymously, let us know and we will let them know. If you wish us to not share your email with even them, let us know, and we will honor this request as well. We may send you updates, news, and other information regarding SpiralFunds. Any correspondence that we send will include information and links on how to opt-out, in the event that you no longer wish to receive such correspondence. SpiralFunds reserves the right to send you important, non-promotional correspondence regarding your account, even if you have opted out of our other mailings.
4. Opt-out. We give you the option to remove your PII from our list of active users completely in connection with the termination of your SpiralFunds user account. All unsubscribe or opt-out requests should be sent to us at optout@SpiralFunds.com. SpiralFunds will make every effort to discontinue the use of an individual’s PII as soon as practicable if requested by that individual. We are not responsible for removing your PII from the lists of any third party who has previously been provided your information in accordance with this policy.
D. Cookies
1. What Are Cookies? Cookies are small text files that a website sends to your web browser. The next time your browser requests information from the website, it sends the information in the cookie back to that website.
2. How Are Cookies Used in General? Cookies are frequently used to keep track of how many times a user visits a site and to enhance a visitor’s experience. For instance, some websites use cookies to recognize you when you return and customize your visit.
3. Does SpiralFunds Use Cookies? Yes, SpiralFunds uses cookies to recognize you upon return so that we may restore certain features, such as your settings, your causes, and the retailers you select as your favorites. We also use cookies to allow you to shop and receive credit without having to log in each time you visit SpiralFunds.com. This is provided as a convenience for our members.
4. Do Our Retailers Use Cookies? Our retailers use cookies to track visits to SpiralFunds.com and to track purchases made by SpiralFunds.com visitors, thereby ensuring that SpiralFunds is properly credited. This then allows us to credit our members’ causes.
5. Are Cookies Safe? Cookies that are set by affiliated retailers when you visit SpiralFunds.com are known as “third-party cookies,” since they are not set directly by the site you are visiting (e.g., SpiralFunds.com). Cookies that are set by a retailer can only be seen by that retailer. So, for instance, a retailer cannot see another retailer’s cookies, nor can a retailer see the cookies that SpiralFunds sets. Also, cookies cannot “steal” your PII, and they cannot contain any personal information that you did not submit to the website that set the cookie.
E. Security
The security of your PII is very important to us and we take every commercially reasonable step to attempt to secure your PII. We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect. Only those employees and contractors who need access to your PII in order to perform their duties are authorized to have access. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and SpiralFunds or information stored or transmitted through the Service or on our servers, will be completely free from unauthorized access by third parties such as hackers, and your use of the Service demonstrates your assumption of this risk.
F. Minors
SpiralFunds has no intention of allowing individuals under the age of 18 to register with SpiralFunds, nor collecting PII from individuals under the age of 18. When we become aware that a registered member is under 18, or we have collected PII from an individual under 18 without such individual’s parent or guardian’s consent, we will use all reasonable efforts to prevent further participation from and delete any information collected about that individual.
